For all the purposes of Legal, Policies, Contracts, sales of services & goods by BHF Tech Solution LLP, unless the context otherwise requires, the following terms shall have the meanings assigned hereunder:
“BHF” shall mean and refer to M/s. BHF Tech Solution LLP, a Limited Liability Partnership incorporated under the laws of India and shall include its successors and permitted assigns.
“Customer” shall mean and include any individual, entity, private undertaking, department, agency, or corporation availing construction-related products and/or services from BHF.
“Site” shall refer to the land, premises, or any other location (whether above or below ground) where the Customer requires delivery of goods or execution of services.
“Products” shall mean all construction / non-construction related goods and materials supplied by BHF, as per the scope of the order.
“Services” shall mean all the related services rendered by BHF including repairs, painting, rehabilitation, grouting, project management consultancy (PMC), architectural design, construction, drawings and any other allied construction services. Our Services shall also include Information Technology (IT) Services.
The Customer shall ensure the presence of either the Customer themselves or their duly authorized representative at the designated delivery site. Proper written authorization shall be provided to empower such representative to act on behalf of the Customer.
The Proforma Invoice issued by BHF shall remain valid for seven (7) working days from the date of issuance. Prices and availability are subject to change after expiry. For intraday fluctuating materials such as steel and cement, validity shall be specified accordingly.
BHF, being a product selling platform, does not directly issue Material Test Certificates. Where applicable, certificates provided by manufacturers shall be furnished subject to availability.
Delivered quantities may vary based on availability and feasibility. No rate revision claims shall be entertained. Unit rates shall remain fixed for the entire purchase order quantity.
Delivery partners engaged by BHF shall be responsible for safe transit of goods. Regular goods shall be delivered within seven (7) working days unless stated otherwise in the invoice. Unloading shall be done only at ground floor unless agreed otherwise in writing.
Note: Unloading at higher floors shall attract additional charges payable directly at site.
Customers must inspect materials immediately upon delivery. Any defects, shortages, or damages must be reported within twenty-four (24) hours, failing which the delivery shall be deemed accepted.
Prices stated in the final Tax Invoice are fixed and non-negotiable. No escalation or revision shall be permitted under any circumstances.
For goods, 100% advance payment is mandatory. Payments shall be made via UPI, RTGS, NEFT, or Account Payee Cheque. For services, payment terms shall be governed by the agreed Work Order.
Returns shall be entertained only for defective or incorrect materials reported within 24 hours. Cancellations may attract a cancellation fee of 5% of the order value. Delivery charges, if incurred, are non-refundable.
No warranty is provided beyond standard manufacturer warranties. BHF shall not be responsible for warranty claims.
No compensation shall be payable for delays, downtime, or idling under any circumstances.
Delays due to force majeure events shall result in extension of performance time without compensation or rate revision.
This Contract shall be governed by the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction.
